Terms of service
Article 1 – Definitions
The following definitions apply in these terms and conditions:

Consumer: a natural person acting for purposes unrelated to commercial, professional or business activities.

Day: calendar day.

Digital Content: data produced and provided in digital form.

Distance Contract: a contract concluded between the Trader and the Consumer within a system organized for the remote sale of products, digital content and/or services using one or more means of distance communication.

Durable Medium: any tool — including email — that allows the Consumer or Trader to store information personally addressed to them in a way that allows future access and unaltered reproduction for a period appropriate to the purpose of the information.

Extended Duration Contract: a distance contract relating to a series of products and/or services, for which the obligation of supply or purchase is distributed over time.

Privacy Policy: the document outlining how personal data is processed, available on the Trader’s website.

Right of Withdrawal: the right of the Consumer to withdraw from a Distance Contract within the established period without giving any reason.

Supplementary Contract: a contract whereby the Consumer acquires products, digital content and/or services in connection with a Distance Contract, provided by the Trader or a third party.

Means of Distance Communication: any method that can be used to make offers and conclude contracts without the Trader and Consumer being in the same place at the same time.

Trader: a natural or legal person who offers and sells products, digital content and/or services to Consumers remotely.

Withdrawal Period: the time period during which the Consumer may exercise their Right of Withdrawal.

Article 3 – Applicability
These general terms and conditions apply to every offer by the Trader and to every Distance Contract concluded between the Trader and the Consumer.
The Consumer will be provided with these terms before the contract is concluded or notified how to access them and request a free copy.
If the contract is concluded electronically, the Consumer will receive the terms in a durable format.
Where additional conditions apply to a product or service, the Consumer can always rely on the most favorable terms in case of conflict.
Article 4 – The Offer
If the offer is limited in time or subject to conditions, this will be stated clearly.
Offers are described accurately and include all necessary information about rights and obligations. Images used reflect the products offered. Obvious mistakes are non-binding.
Article 5 – The Contract
The contract is concluded when the Consumer accepts the offer and meets the stated requirements.
If the offer is accepted electronically, the Trader will confirm receipt by email. They may revoke this confirmation within 10 days. In that case, no contract is formed and any payments will be refunded.
The Trader uses appropriate technical and security measures.
The Trader may assess the Consumer's creditworthiness before accepting the order and may refuse it on valid grounds.
Upon delivery, the Consumer will receive:

Instructions on how to exercise the Right of Withdrawal

Information on warranties and after-sales service

Total price, delivery fees, and contract duration if applicable
Article 6 – Right of Withdrawal
The Consumer has 14 days to withdraw from the contract without stating a reason.
This period starts from:

The last item delivered (for multiple products)

The final delivery (for split shipments)

Contract conclusion (for digital content not on physical media)
If the Trader has not informed the Consumer of their withdrawal rights, the period is extended by 12 months.
Article 7 – Consumer Obligations During the Withdrawal Period
The Consumer must handle the product and its packaging with care and may only use it to determine its nature and functioning as in a physical store.
Any reduction in value due to improper handling is the Consumer’s responsibility.
Article 8 – Withdrawal Procedure and Costs
The Consumer must notify withdrawal to men@sposain.it within the allowed period.
The product must be returned within 14 days, in its original condition and packaging if possible, with all accessories.
Return shipping costs are borne by the Consumer unless otherwise agreed.
Responsibility for proper and timely return lies with the Consumer.
Withdrawal also ends any associated Supplementary Contracts.
Article 9 – Trader’s Obligations in Case of Withdrawal
The Trader will refund all payments (including standard shipping costs) within 14 days of receiving notice of withdrawal.
Refunds may be delayed until the product is returned or proof of return is provided.
Refunds are made using the original payment method and are free of charge.
If the Consumer opted for a more expensive delivery method, the additional cost is not refunded.
Article 10 – Exclusion of Withdrawal
Withdrawal does not apply to:

Custom-made or personalized items

Sealed products opened after delivery and not suitable for return

Services fully performed with prior consent and waiver of withdrawal

Items/services subject to financial market fluctuations

Public auction contracts
Article 11 – Payment
Unless otherwise agreed, payment must be made within 14 days of contract conclusion.
For service contracts, the period starts upon confirmation.
Errors in payment data must be reported immediately.
Accepted payment methods on mensposain.com include Credit Card and PayPal.
Article 12 – Privacy Protection
Personal data provided will be processed in accordance with the Privacy Policy available at mensposain.com.
Article 13 – Intellectual Property
All intellectual property rights regarding products sold on mensposain.com belong exclusively to the Trader.
Article 14 – Questions and Complaints
Questions and support requests may be sent to men@sposain.it.
Complaints must be submitted within 14 calendar days from when the Consumer became aware (or should reasonably have become aware) of the reason.
